Section 504 Information

Section 504 of the Rehabilitation Act of 1973 is a civil rights statute which provides that: "no otherwise qualified individual with disabilities in the United States...shall, solely by reason of his/her disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance." 29 U.S.C. 794.

The central theme of the law is to protect people with disabilities. The law has led to the development of specific regulations relative to Section 504 with which the Cambridge Public Schools and all school districts receiving federal financial assistance must comply. Basically, the law states that individuals with disabilities must be protected from discrimination based on their disability. Under Section 504, a person is considered “disabled” if that person:

  • has a physical or mental impairment which substantially limits one or more of such person’s major life activities,
  • has a record of such an impairment, or
  • is regarded as having such an impairment
